This systematic review identifies and critically evaluates instruments that have been developed to measure clinical trial informed consent comprehension in non-cognitively-impaired adults. Literature searches were carried out on Medline (Ovid), PsycInfo, CINHAL, ERIC, ScienceDirect, and Cochrane Library for English language articles published between January 1980 and September 2008. Instruments were excluded if they focused on consent onto paediatric trials, the construct under study was primarily capacity or competency, or the instrument was developed specifically for psychiatric or cognitively-impaired populations. Instruments selected (...) for review were evaluated against the following criteria: (1) method of item generation; (2) type and format of test items; (3) administration and interpretation of test results; and (4) psychometric properties. Three instruments met our defined inclusion criteria: the Deaconess Informed Consent Comprehension Test (DICCT), the Quality of Informed Consent (QuIC) questionnaire and the Brief Informed Consent Protocol (BICEP). Each instrument varied in terms of content measured. Significantly, these are the first standardized instruments developed to assess comprehension in non-cognitively-impaired adults. Yet, each instrument had its own set of limitations such as the lack of generalizability and the absence of details pertaining to how test results should be used to guide clinical decision-making. Standardized clinical trial informed consent comprehension assessments have been developed to identify gaps in research participants' understanding and ensure that respect for patient autonomy is satisfied. This article describes why and how the author started a medical-legal partnership at her small law school, the curricula associated with the medical-legal partnership, and the experience she and her students have had with the curricula to date. It also provides “lessons learned” which may be useful for individuals interested in expanding interdisciplinary and experiential opportunities at institutions that presently lack traditional sources of such opportunities.

"This edited volume explores conceptual and practical challenges in measuring well-being. Given the bewildering array of measures available, and ambiguity regarding when and how to measure particular aspects of well-being, knowledge in the field can be difficult to reconcile. Representing numerous disciplines including psychology, economics, sociology, statistics, public health, theology, and philosophy, contributors consider the philosophical and theological traditions on happiness, well-being and the good life, as well as recent empirical research on well-being and its measurement. Leveraging insights across diverse (...) disciplines, they explore how research can help make sense of the proliferation of different measures and concepts, while also proposing new ideas to advance the field. Obese bodies are simultaneously conceptualized in a variety of paradoxical ways: good consumers who are bad at consuming, too much weight and too little health, disabled bodies that can be “cured” with a shot or pill, identities that should be respected or the symbol of privileges we should eradicate, and agents without the right kind of agency. This paper, like the bodies under discussion, is multifaceted; it ranges from notions of neoliberalism and governmentality, to consumerism and a history of obesity, (...) to healthism and morality. I draw from disability studies, insofar the object of disability studies is a set of social, historical and cultural practices that “regulate and control the way we think through the body” (Davis, 1995, p. 2). Existing as a liminal node, where health, citizenship, and disability collide, obesity provides fertile grounds for interrogating these hermeneutics of life, and in doing so, sheds light on the regulation and control of the body. Specifically, I will interrogate obesity in three ways: first, as a “health” issue, drawing primarily from the normative model, in order to critique the “naturalist” and biostatistical models of health; second, from neoliberal model of consumerism and citizenship, leading into the third interrogation: “obesity” as a health category for bodily regulation and control. In recent literature there is unanimous agreement about children's pragmatic competence in drawing scalar implicatures about some , if the task is made easy enough. However, children accept infelicitous some sentences more often than adults do. In general their acceptance is assumed to be synonymous with a logical interpretation of some as a quantifier. But in our view an overlap with some as a determiner in under-informative sentences cannot be ruled out, given the ambiguity of the experimental instructions and the (...) attitude of trust by children in adults. Our study investigated this hypothesis with different experimental manipulations. We found that when the experimenter's intentions are clear (Experiment 1, all / some order effect; Experiments 2 and 4, conditions 2 and 3), under-informative sentences are usually rejected; otherwise (Experiment 1, some / all order effect; Experiments 3 and 4, control condition) they are accepted. However, analysis of verbal protocols indicated that pragmatically infelicitous sentences are accepted, with some interpreted mostly as a determiner, irrespective of the function of some as a quantifier. Acceptance is not in itself synonymous with a logical interpretation of some as a quantifier. (shrink)

Philodemus’s On Frank Criticism offers a unique conception of friendship that relies on frank speech, or truth-telling. The ability to have frank conversations with one another is the heart of a conception of friendship in which we are seen, heard, and acknowledged. This is the friendship through which we become better citizens and better selves. In particular, Philodemus is offering this truth-based friendship to students and their mentors. Yet, one would be hard put to find such trust and deep friendship (...) in the university philosophy classrooms of today. Our professionalized and content acquisition focused culture in the academy all too often inhibits fostering these kinds of relationships with our students. We begin the essay by tracing the roots of this kind of frank friendship in Plato’s Lysis, and then contextualize its emerging role in the ancient philosophical classroom by exploring its place in Philodemus’ Epicurean philosophical community at Herculaneum. We do so to see how such friendship moves beyond discourse and into practice. Next, we use Arendt and Foucault to unpack the public and private dimensions of frank friendship in the philosophical learning environment and its role in a good life and good politics. Finally, we show how the classroom practice of Modern Socratic Dialogue (MSD) can re-enliven frank friendship as a spiritual exercise in the contemporary university-philosophy classroom. Specifically, we argue that MSD is a particular method of dialogue suited for the public realm of friendship and that it contributes to the care of one’s soul, thus modeling in our classrooms a method of dialogue for both the public and private dimensions of life. This article puts forth Modern Socratic Dialogue as a pedagogical tool for cultivating an American Bildung. Beginning with Michael Hogue’s work on “resilient democracy,” an associational ethos that is vulnerable and based on our lived uncertainty. To further establish this American Bildung, I investigate what it means to be American. Drawing from the works of Michael Walzer and Gloria Anzaldúa, I establish that “American” means unfinished, pluralistic, and embraces ambiguity. The question of how to cultivate this pluralistic, ambiguous, and vulnerable (...) Bildung is framed by the freedom and social bonds of Wilhelm von Humboldt’s theory of Bildung. For an American Bildung to flourish, freedom and social bonds can be presented and practiced in the form of Modern Socratic Dialogue – “truths” are created by the community of interlocutors, and problems and solutions are based on the experiences of the participants. This article investigates the relation between freedom, the public use of reason, and sensus communis, as discussed throughout Kant’s political writings and critical works. Kant’s discussion of the public use of reason, as put forth in "What Is Enlightenment?" is closely tied to his views on autonomy, most notably in the political sphere. However, Kant’s distinction between the public and private uses of reason relies upon sensus communis as discussed in the Critique of Judgment. The communicability achieved by sensus communis (...) has a relevance not restricted only to Kant’s explicitly political writings; sensus communis is also what we might call “transcendentally significant.” In this article, I argue that the public use of reason—a use of reason achieved by sensus communis—is vital for reason itself to follow its own normative demands. I conclude that sensus communis itself grounds reason’s use for its own critique. (shrink)

Background Advance Care Planning via Group Visits (ACP-GV) is a patient-centered intervention facilitated by a clinician using a group modality to promote healthcare decision-making among veterans. Participants in the group document a “Next Step” to use in planning for their future care needs. The next step may include documentation of preferences in an advance directive, discussing plans with family, or anything else to fulfill their ACP needs. This evaluation seeks to determine whether there are identifiable subgroups of group participants with (...) differing needs prior to delivery of the ACP-GV program and, if so, to use information about the subgroups to enhance the program offered to veterans in United States Department of Veterans Affairs (VA) healthcare settings. Methods We conducted a secondary analysis of national data from a quality improvement evaluation. Patient- and provider-level data from administrative healthcare records for VA users in all 50 states, territories, and the District of Columbia provides data on veterans attending ACP-GV during federal fiscal years 2018–2022 (N = 26,857). Latent class analysis seeks to identify the various subgroups of veterans based on their level of ACP self-efficacy before attending ACP-GV and any demographic differences across the resulting subgroups of veterans attending ACP-GV. ACP self-efficacy is derived from seven items obtained from a participant worksheet used during the group. Results Analysis revealed two distinct groups of veterans, distinguishable by their pre-ACP-GV levels of one aspect of ACP self-efficacy: prior knowledge of ACP. Veterans with higher prior knowledge of ACP are associated with an identified next step focused on checking their current AD status and updating it, and veterans with lower ACP prior knowledge are associated with identifying a next step to discuss ACP more fully with family. Differences in age, sex, race, ethnicity, and marital status exist across subgroups of veterans. Conclusion Greater attention must be paid to ACP and veterans’ prior knowledge of ACP to consistently encourage annual review and status updates. (shrink)

Beyond the study of individual problem-solving capacities of various primates, these hypotheses have demonstrated the close relationship between the complexity of primate social life and the emergence of more sophisticated cognitive skills. The social brain hypothesis demonstrated the existence of a close correlation between the volume of the neocortex and the number of individuals in primate social groups. The amount of (...) studies in this area have increased dramatically and have successfully enhanced our understanding of the evolutionary roots of complex social phenomena, including theory of mind, cultural transmission, social learning, and shared attention. The cognitive capacities present in primates also underlie the evolution of cognitive capacities in humans. Nature contact has associations with emotional ill-being and well-being. However, the mechanisms underlying these associations are not fully understood. We hypothesised that increased adaptive and decreased maladaptive emotion regulation strategies would be a pathway linking nature contact to ill-being and well-being. Using data from a survey of 600 U.S.-based adults administered online in 2022, we conducted structural equation modelling to test our hypotheses. We found that (1) frequency of nature contact was significantly associated with lesser emotional ill-being and greater emotional (...) well-being, (2) effective emotion regulation was significantly associated with lesser emotional ill-being and greater emotional well-being, and (3) the associations of higher frequency of nature contact with these benefits were partly explained via emotion regulation. Moreover, we found a nonlinear relationship for the associations of duration of nature contact with some outcomes, with a rise in benefits up to certain amounts of time, and a levelling off after these points. These findings support and extend previous work that demonstrates that the associations of nature contact with emotional ill-being and well-being may be partly explained by changes in emotion regulation. The ability to process center‐embedded structures has been claimed to represent a core function of the language faculty. Recently, several studies have investigated the learning of center‐embedded dependencies in artificial grammar settings. Yet some of the results seem to question the learnability of these structures in artificial grammar tasks. Here, we tested under which exposure conditions learning of center‐embedded structures in an artificial grammar is possible. We used naturally spoken syllable sequences and varied the presence of prosodic cues. The results (...) suggest that mere distributional information does not suffice for successful learning. Prosodic cues marking the boundaries of the major relevant units, however, can lead to learning success. Thus, our data are consistent with the hypothesis that center‐embedded syntactic structures can be learned in artificial grammar tasks if language‐like acoustic cues are provided. (shrink)

Review of Pragmatism and the Reflective Life.

Concern has been raised that segregation of girls and boys into separate classes leads to increased gender stereotyping. We tested this in a sample of 365 seventh-grade students attending a junior high school that offers both gender-segregated (GS) and co-educational classes. It was found that for both boys and girls, the more GS classes they took in the fall, the more gender stereotyped they were in their responding in the spring (controlling for initial levels of gender stereotyping). We concluded that (...) GS likely heightens the salience of gender in the classroom thereby reinforcing and increasing gender stereotypes. As such, we argue that GS is a misguided approach to addressing any educational difficulties girls and boys might be having. (shrink)

We argue that the relationship between Kant’s theory of imagination and his moral philosophy has not been well understood. Missing is an adequate connection between his idea of sensus communis and the power of imagination to exceed the senses. This connection is close and important, and it has serious implications for how we are to apply and further theorize moral relations among human beings. Especially important in this regard is the ability among humans, in their social setting, to imagine other (...) persons. We do this pre-cognitively, at the level of feeling. The effects of imagining other persons prior to all knowledge of them (as, for instance, rational agents), grounds the autonomy of other persons in a relationship that is far broader than knowledge. In a series of major papers culminating in A Theory of Justice,1 John Rawls constructs an alternative to utilitarianism by developing a social contract theory of moral and political philosophy. Unfortunately, Rawls formulates the two basic principles upon which the theory rests in such a way as to restrict (unduly) the contract theory's applicability (see Section I). In this paper we present a more general discussion of the theory of justice that avoids the problems of Rawls' formulation and yet retains (...) the important idea of justice as fairness and the contractarian approach (Section II). Later it is argued that this more general theory constitutes a bridge between the pure utilitarian theories and the social contract doctrines (Sections V and VI). The theory's advantages are demonstrated by applying it to a problem discussed by Rawls, intergenerational equity, and comparing the two solutions (Section III). BackgroundStory recall tests have shown variable sensitivity to rate of cognitive decline in individuals with Alzheimer’s disease biomarkers. Although SR tasks are typically scored by obtaining a sum of items recalled, item-level analyses may provide additional sensitivity to change and AD processes. Here, we examined the difficulty and discrimination indices of each item from the Logical Memory SR task, and determined if these metrics differed by recall conditions, story version, lexical categories, serial position, and amyloid status.Methodsn = 1,141 participants from (...) the Wisconsin Registry for Alzheimer’s Prevention longitudinal study who had item-level data were included in these analyses, as well as a subset of n = 338 who also had amyloid positron emission tomography imaging. LM data were categorized into four lexical categories, and by serial position. We calculated difficulty and discriminability/memorability by item, category, and serial position and ran separate repeated measures ANOVAs for each recall condition, lexical category, and serial position. For the subset with amyloid imaging, we used a two-sample t-test to examine whether amyloid positive and amyloid negative groups differed in difficulty or discrimination for the same summary metrics.ResultsIn the larger sample, items were more difficult in the delayed recall condition across both story A and story B. Item discrimination was higher at delayed than immediate recall, and proper names had better discrimination than any of the other lexical categories or serial position groups. In the subsample with amyloid PET imaging, proper names were more difficult for Aβ+ than Aβ−; items in the verb and “other” lexical categories and all serial positions from delayed recall were more discriminate for the Aβ+ group compared to the Aβ− group.ConclusionThis study provides empirical evidence that both LM stories are effective at discriminating ability levels and amyloid status, and that individual items vary in difficulty and discrimination by amyloid status, while total scores do not. These results can be informative for the future development of sensitive tasks or composite scores for early detection of cognitive decline. (shrink)

The popular trend of manifesting involves supposedly making something happen by imagining it and consciously thinking it will happen in order to will it into existence. In this paper Laura D'Olimpio explains why manifesting is a form of wishful thinking and argues that it is an epistemic vice. She describes how such wishful thinking generally, and manifesting in particular, are epistemically problematic in the ways they obstruct the attainment of knowledge. She further adds that manifesting leaves the epistemic agent (...) vulnerable to unrealistic expectations, being set up for failure, and being prone to self-blame, and it also encourages a blurring of the distinction between thought and truth. D'Olimpio offers an example that demonstrates how manifesting as a particular instantiation of wishful thinking invites and encourages obsessive and compulsive habits and rituals that corrupt the epistemic agent's rational conclusions. Wishful thinking and manifesting negate the role for luck and privilege in achievement and downplay the role of effort and action. D'Olimpio concludes that as educators we may play a role in dispelling the myth that manifesting is a virtuous or beneficial practice and instead teach our students that, as a form of wishful thinking, it is an epistemic vice best avoided. Media and Moral Education demonstrates that the study of philosophy can be used to enhance critical thinking skills, which are sorely needed in today’s technological age. It addresses the current oversight of the educational environment not keeping pace with rapid advances in technology, despite the fact that educating students to engage critically and compassionately with others via online media is of the utmost importance. The author also suggests that the Community of Inquiry – a pedagogy practised by advocates of Philosophy for Children – creates a space in which participants can practise being critically perspectival, and can be conducted with all age levels in a classroom or public setting, making it beneficial in shaping democratic and discerning citizens. This book will be of interest to academics, researchers and postgraduate students in the areas of philosophy of education, philosophy, education, critical theory and communication, film and media studies. Educating against extremism doesn't just involve seeking to prevent individuals from becoming extremists or radicalized, although that, of course, is a significant concern. There is also an important role for education in teaching the rest of us, the general populace, the best way to react and respond when we learn of a terrorist attack or consider the potential risk of violent extremism in our community, or even worldwide, given we are connected globally via technology. In this article, Laura D'Olimpio (...) argues that educators have a central role to play in teaching young people to respond to the news of violent extremism and the worry about terrorists and terrorism in ways that support our sense of community and personal well-being. Among the ways in which educators may support such aims is by educating the emotions. There are practical and moral reasons to temper our fearful reactions, and it is in our best interest to educate pupils to avoid allowing fear of terrorists or violent extremism to interfere with their daily lives and actions. D'Olimpio claims that our best response to extremism, both representationally and practically, is to refuse to be terrified. By not being overwhelmed by fear or altering our day-to-day activities, we not only better support a well-functioning democracy and our own happiness or flourishing, but we also disempower rather than empower extremists. This volume investigates the role of the arts in character education. The point of education is to support students to be able to live meaningful, autonomous lives, filled with rich experiences. The arts and aesthetic education are vital to such flourishing lives in that they afford bold, beautiful, moving experiences of awe, wonder and the sublime that are connected to the central human functional capability Nussbaum labels senses, imagination and thought. Everyone ought to have the opportunity to learn about art, to appreciate and create art, to critique art and to understand (...) how we are connected to the culture of our society. A life without art is unimaginable, and to the extent that people lack aesthetic experiences, their lives are impoverished, not ‘fully human’. Given that the distinctive value of art objects is that they afford aesthetic experience, it is upon this foundation that an argument ought to be mounted as to why schooling needs the arts, specialised teachers, and all students deserve aesthetic education. Therefore, in this paper, I offer a defence of compulsory aesthetic education across the curriculum on the basis of the aesthetic experiences the arts afford, and the central role such experiences play in eudaimonia—the flourishing life.
